Tiny Aquarium: Social Fishkeeping Terms of Service & Privacy Policy

1. Introduction

Welcome to Tiny Aquarium: Social Fishkeeping (the “Service”), provided by Lunheim Studios (“we,” “us,” or “our”). By accessing or using our Service, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

2. Acceptance of Terms

By creating an account or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you do not agree, please refrain from using the Service.

3. Service Description and Platform

Tiny Aquarium: Social Fishkeeping is an online, real-time aquarium simulator where players create and customize their own aquariums and visit others’ creations.

4. Account Registration & Authentication

Account Creation: To access certain features of the Service, you must register for an account using your Steam credentials via the Steam API.
Security Responsibility: You are responsible for maintaining the confidentiality of your Steam account details and for all activities that occur under your account.

5. User Conduct & Content Moderation

User Responsibilities: You agree to use the Service only for lawful purposes and in accordance with these Terms.
Aquarium Creation & Social Interaction: Users may create, customize, and publicly display their aquariums, as well as visit other players’ aquariums.
Reporting & Moderation: To ensure a safe environment, the Service provides a reporting feature for aquariums that may violate community guidelines. Reported content is manually reviewed by our moderation team. Abuse of this system may result in suspension or termination of your account.

6. Data Collection & Privacy

a. Data Collection

Collected Information: We collect game-related data and the associated Steam ID necessary to authenticate and personalize your experience.
No Additional Personal Data: We do not collect personal data beyond your Steam identifier and game-related data.

b. Data Storage and Retention

Data Storage: All collected data is stored securely on our backend servers hosted on Heroku.
Retention Policy: Your data is retained indefinitely unless you request its deletion. Upon a valid request, your data will be erased in accordance with applicable legal requirements.

c. Data Usage

Purpose of Collection: The collected data is used solely to provide, maintain, and improve the Service, as well as to enforce these Terms.
Third-Party Disclosure: We do not share or sell your data to any third party. Data may be disclosed only when required by law or in response to a valid legal request.

d. Security Measures

Data Protection: We employ industry-standard security measures to protect your data. However, no data transmission over the internet is entirely secure, and we cannot guarantee absolute security.

Suspension/Termination: We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for conduct that violates these Terms or for any other reason at our sole discretion.
Effect of Termination: Termination of your account does not relieve you of obligations incurred prior to termination, and we will continue to enforce any outstanding claims against you.

9. Disclaimer of Warranties & Limitation of Liability

No Warranty: The Service is provided “as is” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
Limitation of Liability: In no event shall Lunheim Studios be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Germany. Any disputes arising out of these Terms or the Service will be subject to the exclusive jurisdiction of the German courts.

11. Changes to Terms and Privacy Policy

We reserve the right to modify these Terms and the Privacy Policy at any time. We will notify you of significant changes through the Service or via email. Continued use of the Service following any changes constitutes your acceptance of the revised Terms.
